Judge dismissed Atilis Gym owner’s lawsuit for reinstatement of business license

More than a year after Ian Smith and Frank Trubetty sued for trying to restore their municipal business license, Camden County Superior Court Judge Deborah Silverman Katz dismissed their lawsuit on December 9.

According to court documents, the two are the co-owners of Triple Threat Gym, the company publicly known as Atilis Gym.

The judge stated that the decision of the Bellmawr Municipal Council to revoke the commercial license of the stadium was not unreasonable or arbitrary because it was based on the stadium’s failure to comply with three public safety orders within a few months.

These include the executive order on restricted companies issued by Governor Phil Murphy during the public health crisis, the order of the Ministry of Health, and the order of the former judge.

"Although the plaintiff may disagree with the law and the resulting license revocation, subjective beliefs do not constitute unfair results," Silverman Katz wrote in her opinion.

"We are disappointed with this decision, but not surprised," Smith and Trubetty's attorney John McCann said in a written response to New Jersey 101.5.

He also stated that they are carefully reviewing the decision to determine whether they will appeal.

The Belmore Borough Council voted to revoke the gym's license in August 2020.

Smith and Truberti’s defense attorneys said in a court document filed last year: “Bellmawr’s procedures do not require the regulatory agency to conduct any investigation of the facts, but they'deem' it illegal and the gym is not safe.” moon.
